Duque urged: Probe head of Tarlac Prov’l Hospital

TARLAC CITY -- Doctors and workers of Tarlac Provincial Hospital here filed a complaint with the Civil Service Commission to investigate the head of TPH for “oppression, grave misconduct, violation of civil service law and rules and conduct prejudicial to the best Interest of the service.

“We are urgently requesting for the immediate investigation of Dr. Leonardo, Jr. (TPH head) as well as any immediate action or intervention to prevent the continuing violation of our rights as civil servants,” complainants told Duque.

Signatories to the complaint included doctors and non-medical personnel deployed at TPH “acting for and on behalf of almost the entire medical and non-medical staff of the hospital.”

“Through this letter, we are formally initiating this complaint against Dr. Leonardo Mangahas, Jr, OIC – chief of hospital – Tarlac Provincial Hospital for his actions. By his willful and deliberate actions, Dr. Mangahas, Jr. has prejudiced not only our constitutionally-protected rights to due process and lawful employment but also those accorded to us under civil service laws and regulations.”

Their complaint, they said,was a result of Memorandum Order No. 26 s. 2015 dated July, 14, 2015 wherein contrary to the seemingly harmless language of the memorandum, they were actually being forced to submit their “courtesy resignations tantamount to our constructive dismissal because we have refused to accept the imposition by the Provincial Governor of Tarlac of the “Guidelines setting the mechanism on the distribution of service payment derived from PHC” which illegally deprive us of our lawful professional fees.”

“In addition to disregarding our rights under Civil Service Laws and Regulations, our professional fees have even been withheld by Dr. Mangahas, Jr. No valid reason or justification has been given for this refusal to release our due and demandable professional fees. It is our position that this is intended to force us to accept and comply with the above-mentioned “Guidelines Setting the Mechanism on the Distribution of Service Payment Derived from PHC.”

They urged “immediate investigation of Dr. Leonardo, Jr. as well as any immediate action or intervention to prevent the continuing violation of our rights as civil servants.”

Signatories included doctors Antonita M. De Pano, Yamami B. Chan, Harriet C. Sulit, Cristina D. Pascual and Ramon S. Aviguetero.

Non-medical personnel signatories were BonifacioYalung, Ella Ong, Rhonale B. Tolentino and Alden Bergonio.

Copies of the complaint were furnished to CSC commissioners Nieves L. Osorio and Robert S. Martinez.

Health Sec. Janette P. Loreto-Garin and Alexander A. Padilla, president and CEO of PhilHealth were also given copies of the complaint letter.
